Privacy Policy

MindScribber LLC (“MindScribber,” “we,” “our,” or “us”) respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy explains how we collect, use, disclose, and protect information about you when you access or use the MindScribber mobile application (the “App”), the website located at www.mindscribber.com (the “Site”), and any related features, tools, or services offered by MindScribber (collectively, the “Services”).

This Privacy Policy applies to all users, including those in the United States and, where noted, users in the European Union and other jurisdictions.

By using our Services, you acknowledge that you have read and understood this Privacy Policy and agree to our collection, use, disclosure, and retention of your information as described herein. If you do not agree with this Privacy Policy, please do not use our Services.

2. Changes to This Privacy Policy

MindScribber may revise this Privacy Policy from time to time to reflect changes in our practices, legal requirements, or for other operational reasons. When we make material changes, we will update the “Effective Date” at the top of this page and may provide you with additional notice, such as an in-app message or email notification.

We encourage you to review this Privacy Policy periodically to stay informed about how we protect your information. Continued use of our Services after changes become effective means you accept the revised Privacy Policy.

3. Definitions

For clarity throughout this Privacy Policy, the following terms are defined as follows:

  • “Personal Information” means any information that identifies, relates to, describes, or could reasonably be linked to an individual, directly or indirectly.
  • “Services” means the MindScribber App, Site, and all related features, content, tools, and offerings.
  • “Third-Party Services” means external services integrated with or used by MindScribber, including but not limited to Firebase (a Google platform offering backend services such as real-time database, user authentication, cloud storage, and analytics), RevenueCat, Apple In-App Purchases, Google Play Billing, and Google AdMob.
  • “User Content” means journal entries, mood tracker data, stress assessments, or other content that you voluntarily submit or store using the Services.

4. Information We Collect

WWe collect several categories of information to operate and improve our Services, including:

4.1 Information You Provide Directly

  • Registration and Profile Information: When you create an account, we collect your name, email address, and password.
  • Wellness Data: You may voluntarily provide or input information related to your emotional state, stress levels, mood, and other wellness information as part of using journaling or tracking features. We securely store your journal entries and wellness data using Firebase’s cloud infrastructure, which provides real-time database and encrypted storage managed by Google.
  • Payment Information: payment-related information (such as subscription status and purchase tokens) is processed through Apple (for iOS), Google Play (for Android), and RevenueCat, which manage all in-app purchases and subscription validation.
  • Communications: If you contact us directly (e.g., via email or support requests), we collect the information you provide, including any correspondence.
  • Referral Contact Information: If you use our referral feature to invite friends via text or email, the contact details you provide are used only to send the invitation and are not stored by MindScribber.

4.2 Information Collected Automatically

  • Device and Usage Information: We automatically collect certain information about your device and usage of the Services, including IP address, device type, operating system, browser type, pages viewed, and the dates/times of your visits.
  • Geolocation Information: We may collect coarse location data to support certain features, such as local weather indicators within the App.
  • Cookies and Similar Technologies: We use cookies and similar tracking technologies to enhance your experience, analyze usage patterns, and personalize content.
  • Analytics Data: We use tools such as Google Analytics, Firebase, and RevenueCat to collect aggregate information about app traffic, usage patterns, and performance. This information does not create individualized user profiles for targeted advertising.

4.3 Speech-to-Text and Audio Input Data

If you choose to use the Speech-to-Text feature within the App, your voice input is securely transmitted to Apple (for iOS) or Google (for Android) to convert speech into text. Audio data is processed in real time solely for transcription and is not stored, logged, or linked to your user account by MindScribber or these providers.

Use of the feature is optional and subject to Apple’s and Google’s respective privacy terms. You may disable microphone access or revoke permission for Speech-to-Text in your device settings at any time.

4.4 Biometric Authentication (Face ID / Touch ID / Android Biometric Login)

The App offers optional biometric authentication to make logging in or unlocking your journal faster and more secure. This feature uses your device’s built-in biometric system — Face ID or Touch ID on iOS devices, and face recognition or fingerprint on Android devices. When you enable biometric login, your biometric data (face geometry or fingerprint template) is created, stored, and processed exclusively on your device within Apple’s Secure Enclave or Android’s hardware-backed keystore. MindScribber does not collect, receive, store, transmit, or have any access to your face scans, fingerprints, biometric templates, or any raw biometric data. The App only receives a simple “yes/no” response from your device confirming whether authentication succeeded.

5. How We Collect Information

We collect Personal Information in the following ways:

  • Directly From You: When you register for an account, input content into the App, make a purchase, contact support, or otherwise interact with the Services.
  • Automatically: Through cookies, log files, analytics tools, and similar technologies when you use or interact with the Services.
  • From Third Parties: We may receive information from payment processors, analytics providers, or app stores to facilitate transactions or track app performance.

6. How We Use Your Information

We use the information we collect for various lawful business purposes, including:

  • To Provide and Operate the Services: To create and manage your account, enable journaling and wellness tools, process transactions, and provide requested features.
  • To Improve and Personalize Your Experience: To understand how users interact with the Services, analyze usage trends, and develop new features.
  • To Communicate With You: To send transactional communications, respond to inquiries, and provide customer support.
  • To Send Marketing Communications: To send newsletters or promotional materials, where you have consented or as permitted by law. You can opt out at any time.
  • To Ensure Security and Prevent Misuse: To detect, investigate, and prevent fraudulent or unauthorized activities.
  • To Comply With Legal Obligations: To comply with applicable laws, regulatory requirements, and lawful requests from government authorities.

7. Disclosure of Your Information

We may share your Personal Information in the following circumstances, in accordance with applicable law:

  • Service Providers: We share information with trusted vendors who perform services on our behalf, such as backend services and secure storage (Firebase — a Google cloud platform for real-time database, authentication, and hosting), payment processing (payment processing and subscription management (Apple for iOS, Google Play for Android, RevenueCat)), and advertising networks (Google AdMob for free version ads).
  • Affiliates and Partners: We may share limited information with affiliates and partners who help promote MindScribber, in accordance with this Privacy Policy.
  • Legal Compliance and Protection: We may disclose your information if we believe it is necessary to comply with laws, respond to legal processes, protect the rights, property, or safety of MindScribber, our users, or the public.
  • Business Transfers: In connection with any merger, sale of company assets, financing, or acquisition, your information may be transferred to another entity as part of that transaction.
  • With Your Consent: We may share your information for other purposes if you explicitly direct us to do so.
  • • Video Hosting via Streamable: Certain videos available in the App are hosted and streamed through Streamable, a third-party video delivery platform. Streamable may process limited technical data (such as IP address, device type, and playback metrics) necessary to deliver video content. Such processing is governed by Streamable’s Privacy Policy.

8. Cookies and Tracking Technologies

MindScribber uses cookies and similar tracking technologies to enhance your experience, understand usage patterns, and deliver our Services effectively.

  • Performance and Analytics Cookies: Help us understand how users interact with the Services so we can improve functionality (e.g., Firebase Analytics, RevenueCat).
  • Advertising Cookies: Google AdMob may use cookies or similar technologies to display contextual ads in the free version of the App. Ads are not based on your private journaling data.

8.3 How to Manage Cookies

Most browsers allow you to control and block cookies through settings. However, disabling cookies may affect the functionality of certain features. For mobile apps, you may adjust ad preferences through your device settings.

9. Behavioral Advertising

MindScribber may allow third-party advertising partners, such as Google AdMob, to display ads within the free version of the App.

  • Ads shown through AdMob are not based on your private journal entries, mood tracker data, or other sensitive information.
  • These ads may be contextual or based on general usage information and approximate location (e.g., country or city-level geolocation).
  • You can manage ad personalization preferences for Google services through your Google Account settings or device privacy controls.

We do not engage in cross-context behavioral advertising or profiling using sensitive data.

10. Analytics

• Google Analytics: Collects aggregate information about app traffic and general user behavior to help us improve performance and user experience.
• Firebase Analytics: Collects aggregate data on user interactions, session durations, device types, and crash reports.
• RevenueCat: Provides metrics on in-app purchases and subscription analytics.
All analytics data is processed in aggregate and is not used to create individual marketing profiles.

11. Third-Party Links and Integrations

Our Services may contain links to third-party websites, plug-ins, or integrations that are not owned or controlled by MindScribber. For example, we may link to resources or allow sharing through social platforms.

This Privacy Policy does not apply to third-party websites or services. We encourage you to read the privacy policies of any third-party services you visit or use. We are not responsible for the content, privacy, or security practices of third parties.

12. Data Retention

MindScribber retains your Personal Information only for as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law.

  • Account Information: Retained for as long as you have an active account.
  • User Content: Stored securely while your account is active; deleted promptly upon your request for account deletion.
  • Deleted Accounts: When you request deletion, we aim to remove all associated Personal Information immediately, but we reserve up to thirty (30) days to complete full removal from backup systems and logs.

We may retain certain information as necessary to comply with legal obligations, resolve disputes, and enforce our agreements.

13. Security of Your Information

MindScribber implements reasonable physical, technical, and organizational safeguards to protect your Personal Information from unauthorized access, alteration, disclosure, or destruction.

Key measures include:

  • Encryption of sensitive data in transit and at rest (e.g., journal entries stored via Firebase).
  • Secure account login credentials.
  • Limited access to Personal Information by authorized personnel only.

Despite these efforts, no method of transmission or storage is completely secure. We cannot guarantee absolute security, and you use the Services at your own risk.

For transparency, our handling of Speech-to-Text and Streamable-related data is described in Sections 4.3 and 7 of this Policy.

14. Children’s Privacy

MindScribber does not knowingly collect or solicit Personal Information from children under the age of thirteen (13).

If you are under 13, please do not register for an account or submit any Personal Information through the Services. Parents and legal guardians who believe that their child has provided us with information without their consent should contact us, and we will promptly delete such information.

For minors between 13 and 18 years old, use of the Services is permitted only with the consent and supervision of a parent or legal guardian who agrees to be bound by this Privacy Policy and our Terms of Use.

15. Your Choices

You have control over how we collect and use your information. Depending on your location and applicable law, you may have the following choices:

  • Account Information: You can review and update certain account details by logging into your account settings.
  • Marketing Communications: You may opt out of receiving promotional emails by following the unsubscribe instructions in those emails or by contacting us at app@mindscribber.com. Note that you will still receive transactional or account-related messages.
  • Cookies: You can set your browser to refuse all or some cookies or to alert you when cookies are being sent. Please refer to your browser’s settings for more information.
  • Ad Preferences: You can adjust ad personalization preferences on your mobile device or in your Google account settings to limit interest-based ads.

16. Your Privacy Rights (US Residents)

Depending on where you live, you may have certain privacy rights under applicable U.S. laws, including the California Consumer Privacy Act (CCPA) and other state laws.

For all U.S. users, you may have the right to:

  • Request access to the Personal Information we hold about you.
  • Request correction or updates to inaccurate or incomplete Personal Information.
  • Request deletion of your Personal Information, subject to certain exceptions allowed by law.
  • Request information about how we share your data.

For California Residents (CCPA):
You have the right to request:

  • The categories and specific pieces of Personal Information we have collected about you.
  • The categories of sources from which Personal Information is collected.
  • The business or commercial purpose for collecting your Personal Information.
  • The categories of third parties with whom we share Personal Information.
  • Deletion of your Personal Information, with some legal exceptions.
  • That we not discriminate against you for exercising any of your privacy rights.

17. Do Not Sell My Personal Information

MindScribber does not sell your Personal Information as defined under the CCPA and other applicable laws.

We do not sell or rent your data to third parties for monetary or other valuable consideration. If we ever change our practices to sell data in the future, we will update this Privacy Policy and provide you with a clear and easy way to opt out, as required by law.

18. Notice for Illinois Residents

MindScribber is based in Illinois and complies with applicable state privacy laws, including the Illinois Biometric Information Privacy Act (BIPA) and the Illinois Personal Information Protection Act (PIPA).

  • Biometric Information: The App offers optional biometric authentication (Face ID/Touch ID on iOS and face/fingerprint recognition on Android). All biometric data is processed and stored solely on your device. MindScribber does not collect, store, or process biometric identifiers or biometric information as defined under BIPA.
  • Notification: If we experience a security breach involving your unencrypted or unredacted Personal Information, we will notify you in accordance with Illinois law.
  • State Rights: You may have additional rights under Illinois law. Please contact us if you have questions about your privacy rights specific to Illinois.

19. GDPR Notice (EU/UK Residents)

Although MindScribber primarily serves users in the United States, we recognize that some users may access the Services from the European Union (EU) or United Kingdom (UK). If you are located in the EU/UK, we process your Personal Information in compliance with the General Data Protection Regulation (GDPR) and applicable local laws.

Legal Bases:

  • Contractual necessity (to provide the Services you requested).
  • Your consent (for optional features like newsletters).
  • Legitimate interests (improving our Services and ensuring security).
  • Compliance with legal obligations.

Your Rights under GDPR include:

  • Access, correction, or deletion of your Personal Information.
  • Restriction or objection to certain processing.
  • Data portability.
  • Lodging a complaint with your local data protection authority.

20. Data Transfers & Storage

MindScribber is based in the United States, and your Personal Information may be transferred to, stored, or processed in the United States and other jurisdictions where our service providers operate.

We take appropriate safeguards to protect Personal Information transferred internationally, including using standard contractual clauses approved by the European Commission where applicable.

21. How to Exercise Your Rights

To exercise any privacy rights described in this Privacy Policy (including access, correction, deletion, or requests under CCPA or GDPR), please contact us by:

For your protection, we may need to verify your identity before processing certain requests. We aim to respond to valid requests within 45 days, or as required by applicable law.

22. HIPAA Notice

MindScribber is not a healthcare provider and is not a “covered entity” or “business associate” as defined by the Health Insurance Portability and Accountability Act of 1996 and its implementing regulations (“HIPAA”).

While MindScribber allows you to input wellness-related information for your personal use, such information is not Protected Health Information (PHI) under HIPAA.

We do not access, store, or process PHI on behalf of healthcare providers. Any health or wellness data you submit is handled in accordance with this Privacy Policy but is not subject to HIPAA protections.
